By accessing or using our website you agree to be legally bound by these Terms and Conditions as they may be modified and posted on our website from time to time.

CopperPoint Ltd understands that many consumers are wary of shopping on the internet, but we can assure you that shopping at CopperPoint Ltd is completely safe and secure.

Our secure server encrypts all information you give us, including your name, address and credit or debit card details, to ensure that this information can be safely transmitted through the internet on-line order payment is processed via the Paypal secure payment system.

The Contract:

By purchasing goods from CopperPoint Ltd you are entering into a legally binding agreement with us. Your statutory rights are not affected.

These terms describe the basis for purchase by you (the customer) and sale by us (CopperPoint Ltd) of the products described on this web site.

The Order

The quantity, quality and description of the products you will receive will be those set out in your order.

Orders are accepted at the sole discretion of CopperPoint Ltd and are normally only accepted :

A ) if the products are available from stock or a delivery date has been agreed by both parties, namely the buyer and the seller.
B) the order reflects current pricing,
C) you are based in the delivery area and
D) your credit or account card is authorised for the transaction.

CopperPoint Ltd is entitled to refuse any order placed by you, providing a refund of any monies paid for that order. Accepted orders will be fulfilled around the estimated date set out in the confirmation or, if the confirmation does not contain such a date, within 21 days. If you do not receive a confirmation email, please contact us to ensure your order has been accepted. You undertake that all details you provide us for the purpose of purchasing products or services which may be offered by us on our website will be correct, that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products or services. We reserve the right to obtain validation and verification of the authenticity of your credit or debit card details before providing you with any products or services. On-line order payment is processed via the Paypal secure payment system.

Price of Goods

Prices listed are in £GBP and are inclusive of delivery costs (for exceptions please read Deliveries) and VAT.

CopperPoint Ltd reserves the right to change the prices of our products at any time and without prior notice.

If the prices of our products change for any reason between the date we accept your order and the proposed delivery date, we will inform you and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable, you will of course be given the option to cancel your order and receive a full refund.

Payment

CopperPoint Ltd accepts payment through Paypal, all major credit and debit cards, including MasterCard, Visa, Visa Electron, Switch and Solo, UK Maestro, Delta and American Express.

We will charge your credit card account for payment upon receipt of order unless delivery cannot be fulfilled within 21 days. This is to protect CopperPoint Limited from credit card fraud.

Bank cheques are not accepted.

Deliveries

Delivery is FREE** to most UK mainland destinations (England, Scotland and Wales) destinations. Deliveries to the Channel Islands, Northern Ireland, Isle of Man, Isle of Wight, BFPO (British Forces Post Office) addresses, Orkney, Shetland, Scottish Isles and some areas/post codes in mainland Scotland will incur a delivery charge and will possibly incur an extended lead time.

Deliveries can take between 2 - 7 working days.

By agreeing to the Terms and Conditions you are also agreeing to accept delivery charges should your postcode/area necessitate these. You are also agreeing to be bound by all Terms and Conditions that delivery companies which are associated with us abide by.

We deliver the products you order to the address you specify for delivery. It is important that this address is accurate. It is a condition that all orders despatched will require a signature on delivery; we will never leave items unless they have been signed for.

We cannot accept any liability for any loss or damage to the products once they have been delivered and signed for. We aim to deliver the items ordered by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we or the carrier will contact you to arrange an alternative time.

Should delivery be refused at the delivery address, and re-requested for another date, we may charge for the second delivery, since we met our delivery obligations with the initial delivery attempt. It is the recipient’s responsibility to sign for the correct number of packages as shown on the carrier’s Delivery Consignment Note. Shortages must be noted on the Delivery Consignment Note. You must also notify us of the shortages within 3 working days of delivery. If boxes look damaged on delivery we recommend that the contents be inspected and found satisfactory before accepting and signing the Delivery Consignment Note. If found not acceptable, the item must be resealed and secured within the packaging and the Delivery Consignment Note signed accordingly. Do not accept the package.

If you wish to order products to be delivered outside the UK, please contact us to make arrangements.

Whilst we agree to use all reasonable endeavours to ensure that delivery is made around the delivery time advertised, you will acknowledge that actual delivery is often via third party suppliers and carriers and can therefore be beyond our control. Incorrect personal details may lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full address details, including accurate postcode of the delivery address and your daytime contact telephone numbers and email address so we can notify you in the event of a delivery problem.

All goods must be signed for by an adult aged 18 years or more. Products will be deemed your responsibility once they have been received by you, your agent or the intended recipient. Any loss or damage to the products shall then be at your own risk.

Ownership

You will only own the goods once we have received cleared payment in full and they have been successfully delivered.

Risk of damage to or loss of items purchased from CopperPoint Ltd passes to you at the time of delivery.

Complaints

CopperPoint Ltd undertakes to handle a complaint fairly and competently. You will be kept informed either by telephone or email at each stage and the company will endeavor to fully resolve your complaint within 48 hours. Cancellations and Returns

We endeavour to provide the best Customer Service possible, however, should you wish to amend or cancel your order, please email us.

If you cancel your order via telephone your Order will be put on hold. You must confirm your wish to cancel the order in writing via email or post within 3 calendar days. Your order will not be considered cancelled until notification in writing is received.

If you decide to cancel an order after the products have been despatched and commenced their carriage to you by carrier or post, we may charge you for the carriage of those products. We advise you check the status of the order before you request cancellation. Any charges will be communicated to you before we confirm the cancellation.

Before you request or arrange the return of a product, please read the information below carefully. You may return any delivered products you have purchased within 7 calendar days of delivery for any reason. To do so you must notify us in writing via email or post within 3 calendar days of delivery. If you are returning a product for any reason except damage (informed to us on delivery date) you must pay the cost of returning the products to us or our suppliers. All returned products must be completely disassembled and correctly placed in all original packaging. We may require photographic evidence of the satisfactory condition of the item you are returning. This will be at our discretion. Electronic files should be forwarded to us and we will obviously also accept printed media.

Product Collection

We will collect the products from you and you will receive a full refund and may be exempt from additional delivery charges if:

  1. the product delivered is not what you ordered (including an unapproved substitute product), or does not correspond with its description;
  2. the product arrives damaged or faulty and you have notified us with 3 calendar days, we may replace the item or affected parts or you may cancel the order and receive a full refund. You will not be charged for the cost of returning an unapproved substitute or defective product. If products arrive in a damaged condition you must make a note on the carrier’s delivery consignment note and inform us within 3 working days of the Delivery.

We will not accept returns or cancellations if the products have been altered by applying chemicals or paints to the surfaces or by altering or customising the product in any way that could be deemed as you using or treating the products as your own, including fully assembling the products. While in your possession, you must keep any products you intend to return to us in good condition. Products must be returned in the same condition as they were delivered. If the products were delivered flat packed they must be returned in the same way including complete disassembly. Care must be taken to ensure the return products are packed well in their original packaging to avoid damage or loss of parts in transit. Products returned which cannot be re-sold as new due to damage or wear and tear may be subject to a reduction in the refund given.

Refunds

Refunds will be processed within 30 days. Where exchange rates of currency are involved, the refund will be made in £GBP at the current exchange rate. We do not accept responsibility for any loss or gain caused by changes in the exchange rate between the time of ordering and the time of issuing the refund.

By law, customers in the European Union have the right to withdraw from the purchase of an item within a “cooling off period” of seven working days of the day after the date the item is delivered.

If you choose to return an item to CopperPoint Ltd during this cooling off period and there has been no error on your part, we will refund you the cost of the item and the cost of delivery. CopperPoint Ltd will not, however, refund you the cost of returning the item unless you are returning it because it is damaged, defective or because of an error on our part which you recorded on the consignment delivery note at the time of receipt or e-mailed the details to CopperPoint shortly after the delivery and at most within 24 hours of receipt.

Although you are not required to give any explanation for returning the product during this cooling off period, CopperPoint Ltd appreciates all positive and negative feedback from our customers in order to help us improve our products and services for the future.

CopperPoint Ltd reserves the right to refuse any returns. This does not affect your statutory rights.

Warranties

Although CopperPoint Ltd aims to provide our customers with high quality products and takes all reasonable steps to ensure you are pleased with your purchase, unless otherwise stated our products are covered only by the manufacturer’s guarantee.

Additionally, CopperPoint Ltd will not be held liable to you or in breach of contract for any delay or failure to perform due to a cause beyond our reasonable control.

The Website - Copyright and monitoring

The contents of our website are protected by international copyright laws and other intellectual property rights. The owner of these rights is CopperPoint Ltd, its affiliates or other third party licensors. All product and company names and logos mentioned in our website are the trade marks, service marks or trading names of their respective owners, including us. You may down load material form our website for the sole purpose of placing an order with us or using our website as a shopping resource.

However, you may not modify, copy, reproduce, republish, upload, post, transmit or distribute, by any means in any manner, any material or information on or downloaded from our website including but not limited to text, graphics, video, messages, code and/or software without our prior written consent, except where expressly invited to do so.

Provisions

We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content shall be subject to these Terms and Conditions.

Please note that although we try to ensure that the content of our website is accurate, our websites may contain typographical errors or other inaccuracies.

We may assign, transfer, novate or subcontract any or all of our rights and obligations under these Terms and Conditions at any time.

We may alter these Terms and Conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the Terms and Conditions on our website regularly.

These Terms and Conditions together with the privacy policy, any order form and payment method instructions, if any, are the whole agreement between you and us. You acknowledge that you have not entered into this agreement in reliance upon any statement, warranty or representation made by us or any other person and you irrevocably and unconditionally waive any rights to claim damages and/or to rescind these Terms and Conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the Terms and conditions, privacy policy, order form and payment method instructions.

If any provision or terms of these Terms and Conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other Terms and Conditions and shall be deemed to be deleted from them. These Terms and Conditions and your use of our website are governed by English law and you submit to the nonexclusive jurisdiction of the English court. Except in respect of a payment obligation, neither you nor CopperPoint Ltd will be held liable for any failure to perform any obligation to the other due to causes beyond your or CopperPoint Ltd respective reasonable control. Failure or delay by either party enforcing an obligation or exercising a right under these Terms and Conditions does not constitute a waive of that obligation or right.

These Terms and Conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.

These Terms and Conditions replace all other Terms and Conditions previously applicable to the use of our website and/or sale of the Products.
